Time limits for some of the most likely claims

If you wish to pursue a civil claim then you must ensure that you issue your case within the following deadlines, otherwise you claim is likely to be time barred.

The deadlines are:

  • Judicial Review claim: promptly and within 3 months of date of incident
  • Equality Act 2010 claim for discrimination on grounds of disability, race, sex, sexual orientation etc: within 6 months of date of incident
  • Human Rights Act claim: within 12 months of date of incident (or promptly and within three months if part of a judicial review claim)
  • Assault (with personal injury aspect): within three years of date of injury
  • Negligence: within three years of the date of the incident
  • False imprisonment: within 6 years of date of arrest and detention
  • Malicious prosecution: within 6 years of the date of the prosecution terminating in your favour
  • Misfeasance in public office: within 6 years of the date of the incident
  • Police Complaint (see separate information sheet*). If you wish to make a complaint then you must ensure that you lodge your complaint within 12 months of date of incident complained of.
