Police misconduct

Bindmans has been at the forefront of protecting the rights of those abused or mistreated by the police and other detaining authorities for over 30 years.

Our lawyers have developed expertise in this complex area to ensure we are best placed to holdto account public officials who have abused their powers.

Being mistreated by those whose duty it is to protect us can be a devastating experience. It can cause serious physical and emotional damage and place livelihoods and relationships at risk. We are skilled in supporting our clients, while advocating robustly on their behalf. Our objective is always is to achieve justice for our clients.

We offer a complete service closely focused on what our client wishes to achieve. This can range, for example, from disciplinary proceedings against an individual officer, to a compensation claim, to a public inquiry. We specialise in cases involving the misuse of power, including harassment, false imprisonment, assault, malicious prosecution, discrimination, and breaches of other human rights and data protection legislation. Seeking answers and accountability for those whose loved one has died in custody forms part of our most important work.

Bindmans has unparallel resources in this area and the breadth of legal expertise available across the firm means we can ensure every aspect of a case - whether criminal defence, medical negligence, defamation, and/or immigration advice - can be thoroughly explored to achieve the fullest possible redress. We are also one of the few firms specialising in applications under the Miscarriages of Justice scheme.

The team

With a strong reputation for our police misconduct work, the team acts in many high profile cases. The team includes Chez Cotton, who leads the department, and Najma Rasul. They work closely with colleagues in the firm, John Halford and Stephen Grosz, in taking challenges against the police, prison and immigration services.

Whatever the case, at every stage, we offer the best possible legal advice and the fullest possible support.  Our clients include those with no previous contact with police; investigative journalists arrested during the course of their work; those who have previous experience of the police. We offer a thorough and cost-effective service to both publicly and privately funded clients.

We make a thorough assessment of every case at the outset and give clear and realistic advice about the chances of success. Our judgement is respected by peers and opponents alike and we have an unrivalled record for winning our cases. We are one of only a small number of firms quality-approved by the Legal Services Commission to do this work.
